Professional Experience
David “Dave” Navarro is a director and shareholder of the firm and has practiced law for more than two decades, representing businesses, landowners, and entrepreneurs in sophisticated transactional matters and complex litigation. He is known for delivering practical, results-oriented representation with a focus on efficiency and cost-effective outcomes. Mr. Navarro maintains a high level of personal involvement in every matter and provides each client with direct access to him, including his personal mobile phone number.
He joined the firm in 2002 after practicing with Gardere Wynne Sewell LLP (now Foley & Lardner LLP) in Dallas, Texas. Mr. Navarro is licensed to practice law in Texas and New Mexico.
Before attending law school, Mr. Navarro worked in the securities brokerage division of USAA Investment Management Company, where he held multiple NASD securities licenses. During that time, he also served as an Adjunct Professor at the University of the Incarnate Word. His business and financial background informs a practical, commercially focused approach to both transactions and litigation, particularly in matters where strategy, risk, and cost must be carefully balanced.
Practice Overview
Mr. Navarro maintains a broad-based practice spanning complex transactions and high-stakes litigation, with particular strength in the energy, real estate, and business sectors. He is frequently engaged in matters involving significant assets, operational risk, or disputes among owners and stakeholders.
He is known for a results-driven, efficient, and cost-conscious approach to representation. Mr. Navarro places a premium on practical solutions and proportional strategy, with the objective of achieving favorable outcomes without unnecessary expense. Every client has direct access to him, including his personal mobile phone number, and matters are handled with a high level of personal involvement rather than delegation.
In addition to serving as lead counsel, Mr. Navarro is often brought into existing cases to assist other lawyers with strategy, motion practice, trial preparation, or discrete issues requiring experience in energy, real estate, or complex business disputes.
Transactional Practice
Mr. Navarro represents clients in a wide range of business and commercial transactions, including:
- Oil and gas and energy transactions, including leases, fuel and chemical purchase and sale agreements, surface use agreements, pipeline and infrastructure easements, joint operating agreements, mineral and royalty acquisitions, and related title matters
- Real estate transactions involving commercial, industrial, ranch, residential and development properties
- Business formation and structure, mergers and acquisitions, business divestitures, and asset sales involving closely held and middle-market companies
- Healthcare transactions, including entity formation, ownership restructuring, and operational agreements
- Alternative energy projects, including solar and other infrastructure-driven developments;
General business structuring, governance, and contract negotiation for owners, operators, and investors
He is routinely involved from the early structuring phase through negotiation and closing, with a focus on risk allocation, operational control, and long-term asset protection.
Litigation Practice
Mr. Navarro is an experienced trial lawyer who regularly appears in state and federal courts and is known by courts and opposing counsel as an attorney who prepares cases to be tried, not merely postured for settlement. His approach emphasizes early issue identification, focused discovery, and decisive motion practice, with the objective of moving cases efficiently toward resolution or trial.
His litigation practice includes:
- Oil and gas and energy litigation involving lease termination, royalty underpayment, surface use and damages, title disputes, pipeline and infrastructure conflicts, and operator–non-operator disputes
- Business divorce and partnership disputes, including claims involving fiduciary duties, control issues, and ownership interests
- Real estate litigation, including disputes involving ownership, boundary disputes, easements, development, homeowner and property owners association disputes, and landlord-tenant matters
- Construction disputes involving commercial and residential projects, contractors, and developers
- Will contests and inheritance disputes involving closely held businesses and valuable real property
- Personal injury and product liability matters
- Consumer and commercial litigation involving contract, fraud, and statutory claims
Clients regularly seek Mr. Navarro’s involvement when disputes intersect with underlying transactional documents or business relationships, allowing him to leverage his transactional experience in litigation strategy.
